Urban Arena Waiver

I, the undersigned, in consideration of my participation, and the participation of those under my supervision and/or responsibility (“Dependents”) in the activities that are offered by the Company and my Dependents’, use of the equipment and facilities provided by the Company, expressly agree and contract, on behalf of myself, my Dependents, my heirs, executors, administrators, successors and assigns, that the Company and its insurers, shareholders, affiliates, branches, employees, officers, directors, and associates, shall not be liable for any damages arising from any personal injuries (including but not limited to disability and death) sustained by me or my Dependents in, on, or about, the premises, or as a result of me or my Dependents’ participation (which may result from, without limitation, hard or laborious physical movements, sliding, stumbling, falling, or other risks).

I understand and acknowledge that:

During my or my Dependents' participation, I or we may be exposed to a variety of hazards and risks, both seen and unforeseen. I am fully aware of the services, equipment and/or other facilities that are offered by the Company. I am also fully aware of me and my Dependents’ physical limitations.

I individually and/or for any/all of my Dependents, understand and accept that the activities that I or we will engage in involve inherent and other risks. These risks can result in varying degrees of physical harm, disability personal injury, disfigurement, and death.

I understand and accept that these activities are strenuous and can be dangerous and require a degree of physical ability, maturity, and skill. I understand that neither the Company nor any of its affiliates or branches will make any evaluation or recommendation regarding me or my Dependents’ sufficient physical fitness for me or my Dependents’ participation.

I acknowledge that it is my sole discretion to use and allow my Dependents to engage in the activities provided and will assume all risks, both inherent and other risks, and accept responsibility for any personal property damage and loss and for any degree of physical harm I and/or my Dependents may suffer.

By the execution of this waiver and release form, I, irrevocably and unconditionally, accept and assume full responsibility for any and all injuries, damages, and losses of any type (including but not limited to economic, non-economic, material, and moral damages and losses), which may occur to me and/or my Dependents and I hereby fully and forever release and discharge the Company, its shareholders, affiliates, branches, employees, officers, directors, and associates, from any and all claims, demands, damages, suits, proceedings, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of me or my Dependents’ Participation.

I expressly agree to indemnify and hold the Company and its shareholders, affiliates, branches, employees, officers, directors, and associates harmless from and against any and all losses, damages, liabilities, obligations, claims, demands, damages, suits, proceedings, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me, my Dependents, or my Dependents’, property or caused by me or my Dependents to any other person or such person’s property.

I agree on behalf of myself and my Dependents to:

(i) Comply with all rules imposed by the Company regarding the Participation.

To conduct myself, and ensure my Dependents conduct themselves, in a controlled and reasonable manner at all times

To refrain from using any equipment in a manner inconsistent with its intended design and purpose.

I understand and agree on behalf of myself and my Dependents that the Company and its shareholders, affiliates, branches, employees, officers, directors, and associates are not responsible for any property that is lost, stolen, or damaged while in, on, or about the premises.

I am aware that it is advisable to consult a doctor or physician before undertaking any physical activity.

I warrant that neither I nor my Dependents:

Suffer from any medical condition and/or incapacity which may impair me or my Dependents’ ability to Participate.

Suffer from any heart condition, epilepsy, allergies, skeletal conditions, spinal, history of sport injury or any other medical condition which may result in me placing myself or my Dependents in a position of risk by Participating.

I also understand that the Company is taking all necessary precautions in terms of social distancing and cleanliness to fight potential transmittable diseases, however, this does not eliminate the chances of transmission. In spite of such risks, I and my Dependents freely wish to Participate and as such, I assume all of the risks and responsibility for the injury, sickness, death or disability that may result to myself or my Dependents, directly or indirectly, when participating or when in, on, or around, the premises.

I further understand, acknowledge and agree that;

(i) The Company and/or any of its affiliates or branches may use any photographs or video footage

of me and/or my Dependents collected during my and/or my Dependents’ Participation for publication and for use in advertising or promotional material.

Such photographs or video footage may appear (whether on their own or in conjunction with other photographs, video footage and/or text graphics) on social media platforms such as Facebook; Instagram; Twitter; YouTube; and/or Snapchat.

I hereby grant the Company and/or any of its affiliates or branches the unfettered right to use all such photographs and/or video footage in such manner; and

I hereby grant the Company and/or any of its affiliates or branches permission to record store, transmit, reproduce, replicate, modify, advertise, and generally exploit all such photographs and video footage for its benefit

I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT AND MY SIGNATURE BELOW CONFIRMS THIS

أنا الموقع أدناه، مقابل مشاركتي ومشاركة من هم تحت إشرافي و/أو مسؤوليتي ("المُعالين") في الأنشطة التي تقدمها الشركة ومن يعولونني، واستخدام المعدات والمرافق التي توفرها الشركة، أوافق وأتعاقد صراحةً، بالنيابة عني، وعن عائلتي، وورثتي، والمنفذين، والإداريين، والخلفاء، والمتنازل لهم، على أن الشركة المنظمة وشركات التأمين التابعة لها، والمساهمين، والشركات التابعة لها، والفروع، والموظفين، والمسؤولين، والمديرين، والزملاء، غير مسؤولين عن أي أضرار ناجمة عن أي إصابات شخصية (بما في ذلك على سبيل المثال لا الحصر العجز والوفاة) أتعرض لها أو لمن يعولني في المبنى أو فيه أو حوله، أو نتيجة لمشاركة أنا أو من أعولني (والتي قد تنتج عن، على سبيل المثال لا الحصر، الحركات الجسدية الشاقة أو المرهقة، أو الانزلاق، أو التعثر، أو السقوط، أو غيرها من المخاطر).

أفهم وأقر بأن:

أثناء مشاركتي أو مشاركة من يعولونني، قد أتعرض أنا أو نحن لمجموعة متنوعة من المخاطر والمخاطر، المرئية وغير المتوقعة. أنا على دراية تامة بالخدمات والمعدات و/أو المرافق الأخرى التي تقدمها الشركة، كما أنني على دراية تامة بالقيود الجسدية الخاصة بي ومن يعيلونني.

أنا شخصيًا و/أو بالنيابة عن أي/جميع من أعولهم، أفهم وأوافق على أن الأنشطة التي سأشارك فيها تنطوي على مخاطر متأصلة ومخاطر أخرى. يمكن أن تؤدي هذه المخاطر إلى درجات متفاوتة من الأذى الجسدي والإعاقة والإصابة الشخصية والتشوه والوفاة.

أدرك وأوافق على أن هذه الأنشطة شاقة ويمكن أن تكون خطيرة وتتطلب درجة من القدرة البدنية والنضج والمهارة. أدرك أنه لن تقوم الشركة ولا أي من الشركات التابعة لها أو فروعها بإجراء أي تقييم أو توصية فيما يتعلق باللياقة البدنية الكافية لي أو لمن يعولني من أجل مشاركة من يعولني أو من يعولني.

أقر بأنه من حقي وحدي استخدام والسماح لمن أعولهم بالمشاركة في الأنشطة المقدمة وسوف أتحمل جميع المخاطر، سواء الكامنة أو غيرها، وأقبل المسؤولية عن أي ضرر أو خسارة في الممتلكات الشخصية وعن أي درجة من الأذى الجسدي الذي أتعرض له. و/أو قد يعاني من يعولني.

من خلال تنفيذ نموذج التنازل والإعفاء هذا، أقبل، بشكل لا رجعة فيه وغير مشروط، وأتحمل المسؤولية الكاملة عن أي وجميع الإصابات والأضرار والخسائر من أي نوع (بما في ذلك على سبيل المثال لا الحصر، الأضرار الاقتصادية وغير الاقتصادية والمادية والمعنوية). (الأضرار والخسائر) التي قد تحدث لي و/أو لمن يعولونني وأنا بموجب هذا أقوم بإبراء وإعفاء الشركة ومساهميها والشركات التابعة لها وفروعها وموظفيها ومسؤوليها ومديريها وشركائها بشكل كامل وإلى الأبد من أي وجميع المطالبات والمطالب أو الأضرار أو الدعاوى أو الإجراءات أو حقوق الدعوى أو أسباب الدعوى، الحالية أو المستقبلية، سواء كانت معروفة أو غير معروفة، متوقعة أو غير متوقعة، ناتجة عن أو ناشئة عني أو عن مشاركة من يعولونني.

أوافق صراحة على تعويض وحماية الشركة ومساهميها والشركات التابعة لها وفروعها وموظفيها ومسؤوليها ومديريها وشركائها من وضد أي وجميع الخسائر والأضرار والمسؤوليات والالتزامات والمطالبات والمطالب والأضرار والدعاوى والإجراءات، حقوق الدعوى، أو أسباب الدعوى، لأي شخص أو كيان، والتي قد تنشأ عن الإصابات أو الأضرار التي لحقت بي، أو بمن أعول، أو بممتلكات من يعولني، أو تسببت بها أنا أو من يعولني لأي شخص آخر أو ممتلكات هذا الشخص.

أوافق بالنيابة عن نفسي وعن من يعولني على ما يلي:

(ط) الالتزام بجميع القواعد التي تفرضها الشركة فيما يتعلق بالمشاركة.

أن أتصرف بنفسي وأتأكد من تصرف الأشخاص الذين أعولهم بطريقة خاضعة للرقابة ومعقولة في جميع الأوقات

الامتناع عن استخدام أي معدات بطريقة لا تتفق مع التصميم والغرض المقصود منها.

أفهم وأوافق بالنيابة عني وعن من يعولني على أن الشركة ومساهميها والشركات التابعة لها وفروعها وموظفيها ومسؤوليها ومديريها وشركائها ليسوا مسؤولين عن أي ممتلكات يتم فقدانها أو سرقتها أو تلفها أثناء وجودها في أو في أو حول المبنى.

أعلم أنه من المستحسن استشارة الطبيب أو الطبيب قبل القيام بأي نشاط بدني.

أتعهد بأنه لا أنا ولا من يعولني:

أعاني من أي حالة طبية و/أو عجز قد يضعف قدرتي أو قدرة من يعولني على المشاركة.

أعاني من أي مرض في القلب، أو الصرع، أو الحساسية، أو أمراض الهيكل العظمي، أو العمود الفقري، أو تاريخ الإصابة الرياضية أو أي حالة طبية أخرى قد تؤدي إلى وضع نفسي أو من يعولني في موقف خطر من خلال المشاركة.

وأدرك أيضًا أن الشركة تتخذ جميع الاحتياطات اللازمة فيما يتعلق بالتباعد الاجتماعي والنظافة لمحاربة الأمراض المحتملة القابلة للانتقال، إلا أن هذا لا يلغي فرص انتقال العدوى. على الرغم من هذه المخاطر، أنا ومن يعولني أرغب بحرية في المشاركة، وعلى هذا النحو، أتحمل جميع المخاطر والمسؤولية عن الإصابة أو المرض أو الوفاة أو الإعاقة التي قد تنجم عني أو عن من يعولني، بشكل مباشر أو غير مباشر، عند المشاركة أو عندما تكون في المبنى أو داخله أو حوله.

كما أنني أفهم وأقر وأوافق على ذلك؛

(ط) يجوز للشركة و/أو أي من الشركات التابعة لها أو فروعها استخدام أي صور فوتوغرافية أو لقطات فيديو

البيانات الخاصة بي و/أو من أعولهم والتي تم جمعها أثناء مشاركة و/أو مشاركة من أعولهم للنشر ولاستخدامها في الإعلانات أو المواد الترويجية.

قد تظهر مثل هذه الصور أو لقطات الفيديو (سواء بمفردها أو بالاشتراك مع صور فوتوغرافية أو لقطات فيديو و/أو رسومات نصية) على منصات التواصل الاجتماعي مثل فيسبوك؛ انستغرام؛ تويتر؛ موقع YouTube؛ و/أو سناب شات.

أمنح بموجب هذا الشركة و/أو أي من الشركات التابعة لها أو فروعها الحق غير المقيد في استخدام جميع هذه الصور و/أو لقطات الفيديو بهذه الطريقة؛ و

أمنح بموجب هذا الشركة و/أو أي من الشركات التابعة لها أو فروعها الإذن بتسجيل وتخزين ونقل وإعادة إنتاج وتكرار وتعديل والإعلان واستغلال جميع هذه الصور ولقطات الفيديو لصالحها بشكل عام.

لقد قرأت التنازل السابق والإفراج عن المسؤولية وقمت طوعًا بتنفيذ هذه الوثيقة مع المعرفة الكاملة بمحتواها وتوقيعي أدناه يؤكد ذلك
